1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of Markish (the "Service").

By creating an account or using the Service, you agree to these Terms.

If you don't agree, don't use the Service.

2. Description of the Service

Markish is a social media management platform that lets you plan, create, schedule, and publish content, collaborate with your team, respond to comments and messages, and view performance analytics across your connected social accounts.

3. Accounts and registration

• You must provide accurate, current information when creating an account.
• You're responsible for keeping your login credentials confidential and for all activity under your account.
• You must be at least 16 years old, or the applicable age of digital consent in your country, to use the Service.
• Notify us immediately at admin@markish.tech if you suspect unauthorized access to your account.

4. Connected social accounts and third-party platforms

The Service integrates with third-party social platforms, such as Facebook and Instagram, through their official APIs.

Your use of those platforms remains subject to their own terms of service.

We are not responsible for changes those platforms make to their APIs, policies, or availability, and we may need to adjust the Service in response to such changes.

5. Acceptable use

You agree not to use the Service to:

• Violate any law or the terms of any connected platform;
• Post content that is unlawful, defamatory, fraudulent, or infringes on others' rights;
• Distribute spam, malware, or engage in coordinated inauthentic behavior;
• Attempt to gain unauthorized access to the Service or other users' accounts; or
• Reverse-engineer, scrape, or interfere with the normal operation of the Service.

We may suspend or terminate accounts that violate this section.

6. Your content

You retain ownership of the content you create and publish through the Service.

By using the Service, you grant Markish a limited license to store, process, and transmit your content solely to provide the Service, for example, publishing a scheduled post to the platforms you've connected.

You're solely responsible for the content you publish and for having the rights to publish it.

7. Subscriptions and billing

Some features of the Service require a paid subscription.

By subscribing, you authorize us to charge your chosen payment method on a recurring basis until you cancel.

Fees are described at the time of purchase and are non-refundable except where required by law.

You can cancel a subscription at any time; cancellation takes effect at the end of the current billing period.

8. Intellectual property

The Service, including its design, software, and branding, is owned by Markish and protected by applicable intellectual property laws.

These Terms don't grant you any rights to our trademarks, logos, or brand assets beyond what's needed to use the Service.

9. Termination

You may stop using the Service and delete your account at any time.

We may suspend or terminate your access to the Service if you violate these Terms, or if we discontinue the Service, with notice where reasonably possible.

10. Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind, express or implied.

To the fullest extent permitted by applicable law, Markish will not be liable for any indirect, incidental, special, consequential, or similar damages arising from your use of the Service.

To the fullest extent permitted by applicable law, our total liability for any claim relating to the Service will not exceed the amount you paid us during the 12 months immediately preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold Markish harmless from claims, damages, liabilities, costs, or expenses arising from:

• your use of the Service;
• your content;
• your violation of these Terms; or
• your violation of another person's rights.

Apply this only to the extent permitted by applicable law.

12. Governing law

These Terms are governed by the laws of Nepal, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the Service will be subject to the jurisdiction of the competent courts of Kathmandu, Nepal, unless otherwise required by applicable law.

13. Changes to these terms

We may update these Terms from time to time.

If we make material changes, we'll notify you by email, through the Service, or by another reasonable method before the changes take effect where required.

Continuing to use the Service after updated Terms become effective means you accept the updated Terms.
